Clear Guidance for Important Property Transactions
Buying or selling property comes with a lot of moving parts. Whether you are purchasing your first home, selling a property, refinancing your mortgage or making changes to a property you already own, the legal details need to be handled carefully.
Real Estate transactions often involve much more than property.
They can represent a new home, an important investment, a family decision or the next step for a business.
Golden Rivers Notary provides real estate notary services in Quesnel with an understanding of what is at stake and the responsibility that comes with helping clients through these important decisions.
With extensive previous experience working with real estate transactions, Rachel Green provides clear guidance throughout the process, helping protect your interests while ensuring you understand what is happening, what is required from you and what comes next.
Buying, Selling or Making a Change to Your Property?
A Notary Public handles the legal work required to complete many types of real estate transactions in British Columbia. These transactions can have legal and financial implications, so it is important to understand what is involved before proceeding.
Where we help
Buying a Property
Your notary helps complete the legal transfer of the property into your name. This can include reviewing the information required for the transaction, working with your lender and other professionals involved, preparing and reviewing legal documents, arranging for signing and completing the necessary registration.
Selling a Property
When you sell, your notary handles the legal documentation required to complete the transaction, works with the other parties involved and addresses financial matters connected with the property so the sale can be completed properly.
Refinancing Your Property
Changing lenders, arranging new financing or accessing equity in your property can require new mortgage documents and changes to the registrations against your title. We can work with you and your lender to complete the legal requirements of the refinance.
Transferring Property
There are many reasons ownership of a property may need to change. Property may be transferred between family members, following a separation or court order, or as part of other personal or financial planning.
Rachel’s previous family law experience also gives her a strong understanding of property matters involving court orders, separation agreements, cohabitation agreements and prenuptial agreements, including the requirements that can arise when ownership needs to change as a result.
Construction Mortgages
Construction financing can involve multiple stages, funding advances and requirements that need to be coordinated as a project progresses. Rachel can work with borrowers, lenders and other parties involved to prepare and complete the legal requirements associated with construction mortgages and help keep the financing process moving forward.
Independent Legal Advice
In some real estate transactions, a person may be required or advised to obtain Independent Legal Advice before signing a mortgage, guarantee, consent, transfer, or other document that may affect their legal or financial interests. This can include someone who is not a registered owner of the property but whose rights or interests may still be affected by the transaction.
Rachel can provide Independent Legal Advice where the matter falls within the scope of notarial practice, giving you the opportunity to review the documents with a legal professional acting independently for you, understand how the transaction may affect you, and make an informed decision before signing.
What to Expect During a Real Estate Transaction
You shouldn't have to understand the entire conveyancing process before calling a notary. Part of our role is to make the legal side of your transaction understandable, explain what needs to happen and guide you through your part of the process.
a Simple Process
01
Start With the Details
Contact us with some basic information about the property and your transaction. From there, we can determine what is required and identify any additional information or documents needed.
02
Preparing the Legal Work
Depending on the transaction, the legal work can include reviewing title information, communicating with lenders and other professionals, preparing documents and addressing the requirements needed to complete the transfer, refinance or other property matter.
03
Reviewing & Signing Your Documents
At your appointment, the documents requiring your signature will be reviewed with you, their purpose explained and your questions answered. The goal is for you to leave understanding what you have signed and how it relates to your transaction.
04
Completing the Transaction
Once all requirements have been satisfied, the necessary documents and funds are handled as required to complete the transaction and register the applicable changes.
Questions are welcome along the way. When you are being asked to provide information or sign an important legal document, you should understand what you are doing and why.
Preparing for Your Appointment
Good preparation helps keep a real estate transaction moving and reduces the chance of avoidable delays.
What Will You Need?
The documents and information required will depend on the type of transaction you are completing. A home purchase with mortgage financing, for example, may require different information than a family transfer or the sale of bare land.
One piece of current government-issued photo identification will be required at your appointment. For transactions where you are gaining an interest in property, your Social Insurance Number (SIN) card will also be required if you are a Canadian citizen, permanent resident or temporary worker.
We'll let you know what is required for your specific matter before your appointment so you have time to gather everything you need.
When Should You Contact the Office?
As early as possible.
Real estate transactions involve other professionals, financial institutions and firm completion dates, so getting in touch early gives us more time to review the details and identify anything that may require additional attention.
You are also welcome to contact us before entering into a firm contract, particularly if you have questions about the legal implications of a proposed transaction or are considering a private purchase or sale without a Realtor involved. You don't need to wait until everything has been finalized to ask questions.
Real Estate Experience You Can Rely On
Golden Rivers Notary is a new practice, and Rachel brings more than a decade of previous legal experience to the work she does today. That experience matters not simply because of the number of transactions she has worked with, but because it has given her an understanding of the details, questions and potential complications that can arise along the way.
When a Transaction Has More Moving Parts
Not every property transaction fits neatly into the standard purchase-or-sale box.
Rachel's previous legal work has included small subdivisions, boundary adjustments, development documents such as easements and covenants, as well as transactions involving court orders, separation agreements, cohabitation agreements, corporations, societies and non-resident parties. She also has experience with matters involving registered financial charges such as judgments, family maintenance orders and non financial charges such as certificates of pending litigation, as well as transactions where non-resident tax implications may need to be considered.
That background helps identify when a matter may require additional attention, understand the different interests involved and provide clear direction as the transaction moves forward.
Experience Across Different Property Transactions
Her background includes residential, commercial and recreational properties, manufactured homes, bare land, Crown land leases, family property matters, private purchases and sales, private lending, and a wide range of financing arrangements.
Rachel has worked with lenders, borrowers, buyers and sellers, giving her perspective on the different parties and requirements involved in completing a property transaction. Each matter is approached carefully, recognizing that clients are placing their trust in Golden Rivers for legal work connected to significant financial and personal decisions.

Earlier is generally better. Once you have an accepted transaction and know your completion date, contacting your notary gives the office time to obtain the necessary information and coordinate with the other parties involved.
If you are considering a private purchase or sale without a Realtor, we encourage you to contact us before signing a contract. Rachel can help you understand the legal requirements of the transaction and, where appropriate, assist with preparing or reviewing the agreement before you commit to its terms.
If you have questions at any stage, you are welcome to contact us to discuss your situation.

We can assist with many family property transfers. These transactions should not be treated as simply changing a name on a title. Depending on the circumstances, there may be additional independent legal advice, tax advice, financing or other considerations that should be addressed before the transfer proceeds.

Complicated real estate matters can involve multiple parties, unusual title issues, financing requirements, court or family matters, and other legal interests that need to be addressed before a transaction can be completed properly.
Rachel’s previous legal experience includes a broad range of complex and less common property matters. That experience helps her identify what needs to be addressed, coordinate with lenders, government agencies, other legal professionals and the various stakeholders involved, and keep the transaction moving toward completion.
The goal is to manage the complexity carefully and thoroughly, so you can feel confident that the legal work has been completed properly. We’ll start by reviewing your circumstances and determining whether the matter can be handled through notarial practice or whether another type of legal assistance is required.

You will need current government-issued photo identification for your real estate appointment.
If you are acquiring an interest in property and are a Canadian citizen, permanent resident or temporary worker, you will also need to provide your Social Insurance Number (SIN) card.
Other requirements will depend on the type of transaction. We’ll provide instructions before your appointment so you know exactly which identification, information and documents you need to bring. Yes. BC Notaries can prepare and file the required Land Owner Transparency Registry documents where disclosure of beneficial ownership or control is required. Generally, beneficial ownership refers to an individual who has the underlying benefit or interest in a property, even though another person or entity may be the registered owner. The Land Owner Transparency Act also requires disclosure of certain individuals with ownership or control through corporations, trusts, and partnerships.
Golden Rivers Notary can help you understand what information is required and prepare the necessary transparency filings as part of your land title transaction, as well as further filings that may be required when beneficial ownership or control changes.
